Legal
Terms
This document is not finished.
1. Who this is between
These terms are between you and the operator of this site (“we”, “us”). By joining the club (creating an account) or using the site you agree to them. If you do not, please do not use the site.
2. Who may have an account
You must be at least 18 years old. The minimum may be lowered in the future; if it is, these terms and the privacy policy will say what changes for younger users before any can sign up. One account per person. Give a real way to reach you and keep your password to yourself — anything done from your account is treated as done by you.
You can answer Chester’s first questions and see the path he writes before you have an account. The account is made only when you tap “Join the club” at the end and tick the box confirming your age and that you agree to these terms and the privacy policy; your answers come with it then. Until that moment nothing you answered is sent to us.
3. What this product does, so nothing is a surprise
aliinuka is a compass for your life: you check in, rate parts of your life, pick directions to work on and take small daily steps. Your compass, directions and steps are private to you.
aliinuka is not medical advice, therapy, or a crisis service. It cannot tell whether you are safe, and nobody watches what you enter. If you are in danger or thinking about harming yourself, contact your local emergency number or a crisis line now; our help page lists free ones.
Promises are one tool on the site, and they are built on a small number of rules that are deliberate, and that you should understand before you post one:
- You cannot mark your own commitment as done. Somebody who signed it has to confirm it. This is enforced by the server, not by the interface, and it is the point of a promise.
- A signature cannot be withdrawn. If you sign somebody’s commitment, that stands.
- A commitment cannot be edited after it is posted, and a deadline that passes unmet is recorded as missed.
- Failure stays on the record. If you post publicly and miss, the miss is public. That is what makes the record mean anything. Choose “connections only” or “only you” if you would rather it were not.
- Visibility can be widened but not narrowed. You cannot post in public, miss, and then hide it.
- Lockdown, if you turn it on. The lockdown and the wheel are available only to accounts an administrator has enabled them for; on any other account they do not appear and never apply. Where enabled, it is off unless you switch it on in your settings. While it is on, you are warned every time you open the site in a commitment’s last ten days, and if the deadline passes on a commitment somebody witnessed, with it neither claimed nor confirmed, your account shows nothing but the punishment wheel until you have served a forfeit and handed in proof. It cannot be switched off while a deadline is inside those ten days.
Forfeits — the wheel — are between you and the people you invite into it, and the site’s own house forfeits when they have not written enough of it. None of the house forfeits costs money or asks you to do anything unsafe. They are not enforceable by us or by anyone else, we do not collect or transfer anything on their behalf, and nothing on this site should be used to compel a payment, a service, or anything else from another person.
4. What you post
You keep ownership of everything you write here. You give us permission to store it and to show it to the people your own visibility setting allows — that is all, and only so the site can work. We do not use your content to advertise, we do not sell it, and we do not train anything on it.
You are responsible for what you post, and you confirm you have the right to post it. Do not upload a picture you do not have the rights to use.
Public means public. Commitments are public unless you choose otherwise, and a miss on a public commitment stays public. Anything public can be seen, copied and shared by people you do not know, and cannot be taken back once it has been. You choose what to make public and accept that risk; we are not responsible for what other people do with it, or for any embarrassment, loss or harm that follows from your choosing to post something publicly. The privacy policy lists what that covers.
5. What you may not do
Do not use aliinuka to:
- Harass, threaten, demean or pile on to another person, including through nudges, notes, messages, groups or forfeits.
- Post another person’s private information, or impersonate anybody.
- Post anything unlawful, or content that sexualises a minor.
- Set, propose or enforce a forfeit that would harm someone, humiliate them, or pressure them into money, property, or anything sexual.
- Sign a commitment you have no intention of judging honestly, or confirm something you know was not done.
- Break, probe or overload the site, or try to read data you are not entitled to.
- Scrape the site, or use it to build a dataset about the people on it.
We may remove content or close an account that breaks these rules. If somebody is in danger, contact your local emergency services — this site is not monitored around the clock and is not a crisis service.
6. Reporting something
If something here is harassing you, puts somebody at risk, or should not be on the site, use the Report link on the commitment or the profile. An admin reads every report. For anything else, including copyright, write to the contact address with a link and enough detail to find it. Copyright complaints should identify the work, the material you say infringes it, your contact details, and a statement that you believe in good faith that the use is not authorised.
7. It is free, and it may not always exist
The site costs nothing to use and takes no payment. See the refunds page, which is short for that reason.
It is run by one person. It may change, break, or be discontinued. There is no uptime promise, no promise that your data will survive a catastrophic failure, and no support commitment. Keep your own copy of anything you would be upset to lose.
8. No warranty
The site is provided “as is” and “as available”, without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not promise the site will be uninterrupted, error-free, or that it will change your life or make you keep your word.
9. Limit of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, for lost data, or for anything another user does to you. Because the site is free, our total liability to you for any claim is limited to one hundred US dollars.
Some states do not allow certain limits, in which case the limits above apply only as far as that state permits, and nothing here removes a right you have that cannot be waived.
10. Content posted by other people
Most of what is on this site was written by its users, not by us. We do not endorse it and are not responsible for it. Where the law gives an online service protection for content its users post, we rely on it.
11. Ending it
You may stop using aliinuka at any time, and you may ask for your account to be deleted — see the privacy policy for what it takes with it. You can do it yourself in settings. We may suspend or close an account that breaks these terms.
12. Governing law
The governing state has not been configured for this deployment. Until it is, no choice of law is stated here rather than a wrong one being implied.
13. Changes
These terms may change. The date at the top changes with them, and a change that materially affects you will be said on the site. Carrying on using aliinuka after a change means you accept it.
